Real estate purchase and sale contract in Hungary - in brief

What is the minimum content of the contract? / How mucsh is the general amount of the deposit? / How long does it take the whole procedure?

In Hungary, the real estate purchase and sale contract must be in writing, which must be countersigned by a lawyer or a notary.

 

If the buyer is not a Hungarian or EU citizen, the contract must also be approved by the state administrative office.

 

The concluded contract must be submitted to the real estate registry office, which will make it legally binding.

 

The minimum content of the contract:
- the seller's name, date and place of birth, mother's name, address, tax number, ID number, bank account number (to which the buyer pays the purchase price) in the case of a foreigner, his Hungarian notification agent;
- the buyer's name, date and place of birth, mother's name, address, tax number, ID number, in the case of a foreigner, his Hungarian notification agent;
- the property's land registry number, exact address;
- subject of the sale (ownership ratio)
- purchase price, down payment, method and time of payment
- date of possession
- signature of seller, buyer, lawyer

 

Deposit

The general amount of the deposit in Hungary is 10% of the purchase price.
If the buyer changes his mind and still does not buy the property, he loses the deposit.
If the seller changes his mind and still does not sell the property, he must pay double the deposit to the buyer.

 

The lawyer is usually selected and paid by the buyer.

 

Time frames:
- preparation, drafting, conclusion of the lawyer's contract: 3-5 days.
- procedure of the state administrative office: usually 45 days
- procedure of the real estate registry office: usually 5-15 days.

 

Costs:
- attorney's fee: 0.5-1% of the property price
- copy of the title deed, which certifies that the seller is the owner: 4,800 HUF
- registration of the change of owner in the register: 10,600 HUF
- registration of ownership immediately: 10,600 + 16,000 HUF
- real estate acquisition fee (tax): 4% of the property price (the tax office may order an inspection in case of a suspiciously low price)
- property energy certificate: 20,000-100,000 HUF
